What are Iskan and Tapu?

July 22, 2020

Surely, reading articles about real estate in Turkey, you have noticed words like ISKAN and TAPU. We will tell you in detail why these documents are so necessary when buying your dream apartment.

ISKAN is a technical passport for real estate. This document contains information about the number of floors, area, wall height, presence and number of independent units in the house. It is possessed only by those developers whose property is legal and ready for operation by agreement of the state commission.
The developer usually presents the finished ISKAN to the buyer. If there is a sale of secondary real estate, then ISKAN is obligatorily transferred to the new owner.

Be careful, renting and selling a house without ISKAN is punishable by law.
ISKAN will not be legally binding without Tapu. This document, issued by the Cadastral Office, awards you the status of "owner". Of course, there are some peculiarities. When registering papers, both parties must be present. If one of them is a foreigner, then he must be accompanied by an interpreter with a different surname. Several legal entities can also be the owner.
You must understand that there are different types of Tapu.

You need to immediately clarify what right it provides:
- ownership of housing that is ready to use
- ownership of housing that is not ready for use
- the right to partial ownership of real estate
Pay attention to the specified data in the papers when concluding them:
- the cost of purchased housing
- type of property
- photos of previous owners
- province or administrative center
- city or urban-type settlement
- microdistrict
- number of the cadastral plan or drawing
- number of the cadastral array or quarter
- land plot number
- block and floor number
- permission to operate
- the reason for the sale (in the case of secondary housing)
- information about the new owner

ISKAN and Tapu are extremely important documents. These papers should be thoroughly checked in order to live peacefully in the house you have dreamed of.
