Surely, reading articles about real estate in Turkey, you have noticed words like ISKAN and TAPU. We will tell you in detail why these documents are so necessary when buying your dream apartment.
ISKAN is a technical passport for real estate. This document contains information about the number of floors, area, wall height, presence and number of independent units in the house. It is possessed only by those developers whose property is legal and ready for operation by agreement of the state commission.
The developer usually presents the finished ISKAN to the buyer. If there is a sale of secondary real estate, then ISKAN is obligatorily transferred to the new owner.
Be careful, renting and selling a house without ISKAN is punishable by law.
ISKAN will not be legally binding without Tapu. This document, issued by the Cadastral Office, awards you the status of "owner". Of course, there are some peculiarities. When registering papers, both parties must be present. If one of them is a foreigner, then he must be accompanied by an interpreter with a different surname. Several legal entities can also be the owner.
You must understand that there are different types of Tapu.
You need to immediately clarify what right it provides:
