Making a will for real estate in Turkey

July 21, 2020

Your dream has come true - you have purchased a coveted apartment in a beautiful country, now you need to take care of one important step. Some people make a will almost immediately after buying a home, so as not to worry about whose hands their house will fall into. This is the right decision. The choice, of course, is yours, but it is our duty to advise you on how to carry out this procedure.

You need to understand that the inheritance of real estate is formalized according to the legislation of the country of which the owner is a citizen. In addition, it is necessary to translate documents into Turkish confirming the relationship, and a court decision on the entry into inheritance. Of course, the procedure becomes easier and faster if the will is drawn up at the location of the property.

The process of formalizing the inheritance with a local notary, who will draw up the text of the will, will take no more than one day, and his services will cost 200-300 euros. You must have a certificate of legal capacity with you, which is valid for one day. Remember, you must be accompanied by an official translator who will orally help you understand the text, and two witnesses. You have the right to amend the content of the document.

You can also draw up a will in Russia, but it will need to be translated into Turkish and certified by a notary in Turkey. This option is more expensive.
After the will comes into force, your heir must use the services of a lawyer with his copy of the will, death certificate and title deeds. Then the lawyer goes to the ministry and sends the papers to court. With the consent of the court, the heir immediately becomes the owner of the property.

Pay attention to the package of documents that you will need:
1. original and copy of the passport;
2. original and copy of the certificate of ownership (Tapu);
3. copies of the passports of the prospective heirs;
4. 4 photos of the property owner;
5. tax number in the country where the property / copy of the residence permit is located;

The will in Turkey: important information for foreigners
