What should I do to rent an apartment for short-term rent?

Short-term rental conditions according to the new law:

Get a certificate from the Ministry of Culture and Tourism. The application can be made online via e-devlet. The decision on the application must come within 30 days. A month after receiving the certificate, a special commission will come to the facility with a check on compliance with all necessary conditions, such as: the presence of a fire extinguisher, an evacuation plan from the building, a sign with information about the rented object at the entrance, smoke detectors, etc. Subsequent inspections will be carried out every 2 years. Information about the certificate received must necessarily be indicated when advertising the object.

Get a work license and a work permit if one owner rents out more than 5 apartments in one building (Işyeri Açma ve Çalışma Ruhsatı)

Get the consent of the owners of all other apartments in the building in which the housing will be rented. Notarize the consent. If the tapu (certificate of ownership) indicates the shares of other owners, then it is also necessary to obtain consent from them to lease the object for a short-term lease (at least 51% by shares and number of people).

Important! For hotel-type complexes, the consent of all other owners is not required if the building management plan (yönetim planı) already has a clause allowing short-term rental. In this case, the management plan will need to be attached to the documents when applying for a certificate.

A maximum of 12 people can live in one apartment at the rate of 2 people per bedroom and 2 people outside the bedrooms (children under 3 years old are not counted).

All of the above procedures can be performed personally or through a trusted person, to whom a notarized power of attorney must be issued.

The law comes into force on 01.01.2024.
