Short-term rent is the rental of real estate for less than 100 days.
Short-term rental conditions according to the new law:
- Get a certificate from the Ministry of Culture and Tourism. The application can be made online via e-devlet. The decision on the application must come within 30 days. A month after receiving the certificate, a special commission will come to the facility with a check on compliance with all necessary conditions, such as the presence of a fire extinguisher, an evacuation plan from the building, a sign with information about the object being rented at the entrance, smoke detectors, etc. Subsequent inspections will be carried out every 2 years. Information about the certificate received must necessarily be indicated when advertising the object.
Documents required to obtain a certificate:
1. Identity card (kimlik) of a Turkish citizen
2. A copy of a foreign passport and a copy of a residence permit (if any) for foreign citizens
3. A photocopy of a TAPU proving that you are the owner of the property
4. Written consent of all owners of the residential complex
- To obtain a work license and a work permit if one owner rents out more than 5 apartments in one building (Işyeri Açma ve Çalışma Ruhsatı)
- Obtain the consent of the owners of all other apartments in the building in which the housing will be rented. Notarize the consent. If the tapu (certificate of ownership) indicates the shares of other owners, then they also need to obtain consent to lease the object for a short-term lease (at least 51% by shares and number of people).
- After receiving all documents, you need to install a sign indicating that an apartment for short-term rent is available in this house.
- Share the agreement and the tenant's data with the police/gendarmerie through the management of the complex or directly, as well as register all tenants who will live in the apartment.
All of the above procedures can be performed personally or through a trusted person, for whom a notarized power of attorney must be issued.
Important:
- For hotel-type complexes (yüksek nitelikli konut), the consent of all other owners is not required, since there is already a point in the building management plan that allows short-term rental. In this case, the management plan will need to be attached to the documents when applying for a certificate. You can check the status of the complex according to the management plan at the Cadastral Chamber.
- A maximum of 12 people can live in one apartment at the rate of 2 people per bedroom and 2 people outside the bedrooms (children under 3 years old are not counted).
- The owner himself or companies with a category "A" license can rent the property.
The law came into force on 01.01.2024.
Fines (for each object):
- 100,000 liras - for the first violation
- 500,000 liras - for the 2nd violation
- 1,000,000 liras - for the 3rd violation
