The Istanbul court sided with the landlord, who wanted to increase the rent for the tenant

December 22, 2023

In Istanbul, a landlord who applied to the court for an increase in rent by more than 25% of the amount specified in the contract won the case despite the fact that the 5-year period after which an increase in rent by more than 25% is possible has not yet expired. The decision in favor of the plaintiff was made by the 54th Civil Division of the Istanbul Regional Court of Appeal.

Umut Metin, the client's lawyer, commented on the situation: "In cases where one or another rent does not correspond to economic indicators in the country and/or is disproportionately low in comparison with the payment for similar facilities in the area, the landlord has the right to file a lawsuit to establish a fair rent. The so-called claim for rent adjustment can be filed even in cases where 5 years have not yet passed since the conclusion of the lease agreement and the rule on the maximum possible 25% increase in fees is in effect."
